TERMS + CONDITIONS 

Elite Portable Bathrooms Northland – Terms and Conditions 

These Terms and Conditions form part of the agreement between Elite Portable Bathrooms Northland and (the customer) for the hire of portable bathroom unit(s).

• Definitions
• • Unit: The portable bathroom supplied for hire.
  • Commencement Date: The date the unit is delivered to the Customer.
  • End Date: The date the unit is collected by the Supplier.
  • Site: The location where the unit is delivered and installed.

• Rental Period
  • The hire period begins on the Commencement Date and ends on the End Date, unless otherwise agreed in writing.
  • Standard hire is for [X days/weeks]. Any extension will be charged at the standard daily/weekly rate unless otherwise agreed.
  • The Customer is responsible for the unit from the Commencement Date until collection, including any damage, loss, or theft. 
  • Failure to make the unit available for collection on the End Date will result in additional hire and/or collection charges.

• Delivery and Collection
  • Delivery and collection will occur on the dates agreed in the booking confirmation.
  • The Customer must ensure clear, safe, and legal access for delivery, installation, servicing, and collection of the unit.
  • Any delays or additional costs caused by restricted access, unsafe conditions, or the Customer’s actions may be charged to the Customer.

• Site Accessibility & Waste Connection 
  • The Customer must ensure the Site is accessible fordeliveryvehicles, installation, servicing, and collection of the unit at all times during the hire period. 
  • A firm, level, and stable surface must be available for positioning the unit.
  • The Customer must provide safe, unobstructed access to a suitable waste pipe or disposal point for connection,locatedwithin [X metres] of the unit’s intended position. 
  • If access is restricted or the waste connection is not available at the time of delivery,additionalcharges may apply for return visits, repositioning, or alternative servicing arrangements.

• Use of the Unit
  • The unit must only be used for its intended purpose.
  • No hazardous materials, chemicals, or non-biodegradable items may be placed in the toilet system.
  • The Customer must not move or relocate the unit.

• Cleaning, Servicing, and Maintenance
  • Units will be supplied in a clean and sanitary condition.
  • Servicing will be carried out at the frequency agreed in the booking confirmation.
  • The Customer must keep the unit in a reasonably clean condition between servicing. 
  • Additional cleaning required due to misuse, vandalism, or excessive mess may result in extra charges.

• Damage, Loss, or Theft
  • The Customer is responsible for all damage (including graffiti), loss, or theft of the unit during the hire period. 
  • Repairs or replacement will be charged to the Customer at cost, plus any associated transport or downtime fees.

• Payment Terms
  • A deposit of [X%] is required at the time of booking to confirm the hire. 
  • The balance is payable [X days before delivery / on delivery / within X days of invoice].
  • Late payments may incur interest at [X% per week] and recovery costs.

• Cancellations
  • Cancellations made more than [X days] before the Commencement Date will receive a full refund of the deposit. 
  • Cancellations made within [X days] of the Commencement Date may forfeit the deposit. 
  • If delivery is attempted but cannot be completed due to the Customer’s fault, the full hire fee may still apply.

• Liability
  • Elite Portable Bathrooms Northland is not liable for any loss, damage, or inconvenience caused by the unit being unavailable due to circumstances beyond our control (e.g., extreme weather, vehicle breakdown).
  • The Customer is responsible for ensuring the site is suitable and compliant with local regulations.

• Termination
  •  We may terminate the hire immediately if the Customer breaches these terms, misuses the unit, or fails to make payment. In such cases, the unit will be collected without refund.

• Governing Law
• • This agreement is governed by the laws of New Zealand.

• Acceptance 
• • By signing the booking form, paying the deposit, or accepting delivery of the unit, the Customer agrees to these Terms and Conditions.
